Chapter One: Introduction

1.1 Background of the Study
Land use and ownership have long been contentious issues in Nigeria, with conflicts arising from unclear land tenure systems, land grabbing, and disputes over land rights. The Nigerian Constitution, while acknowledging the state's power to regulate land, does not provide detailed provisions for individual land rights, which often results in conflicts at the local level (Bala & Jibril, 2023). In Dutse LGA, Jigawa State, these issues are pronounced, as many landowners face challenges related to land use policies, ownership disputes, and insufficient protection of property rights. This study seeks to investigate how constitutional law impacts land use and ownership in Dutse, focusing on its role in addressing land disputes and ensuring equitable land distribution.

1.2 Statement of the Problem
Land use and ownership are critical areas where constitutional protections are essential, yet, in Dutse LGA, landowners and farmers often struggle with issues such as land tenure insecurity, disputes over land rights, and the lack of clear guidelines for land use. This study will explore how constitutional law affects land use and ownership in Dutse and identify the challenges that hinder the effective management of land resources.

1.3 Objectives of the Study

1.5 Research Hypothesis

  • H₁: Constitutional law has a limited impact on land use and ownership in Dutse LGA due to weak enforcement and unclear policies.

  • H₂: Land tenure insecurity and local land disputes hinder the realization of constitutional land rights in Dutse.

  • H₃: Strengthening land policy frameworks and promoting awareness can improve land use and ownership in Dutse LGA.

1.6 Significance of the Study
This study will provide a deeper understanding of the role of constitutional law in land use and ownership, especially in rural areas like Dutse. The findings will be useful for policymakers, landowners, and legal practitioners in addressing land disputes and improving land governance in Jigawa State and beyond.

1.7 Scope and Limitations of the Study
The study will focus on Dutse LGA, Jigawa State, and will evaluate constitutional law as it pertains to land use and ownership. Limitations may include access to official land records and the difficulty of obtaining reliable data from local landowners.

1.8 Operational Definition of Terms

  • Constitutional Law: The legal principles derived from the Nigerian Constitution that govern rights and responsibilities, including land ownership and use.

  • Land Use: The management and utilization of land resources, including agricultural, residential, and commercial purposes.

  • Land Ownership: The legal right to possess, use, and control land, which can be subject to both statutory and customary law.
